Han and Matt Know It All Privacy Policy

Introduction

This Privacy Policy ("the policy") informs you of our policies regarding the collection and use of personal data when you interact with Han and Matt Know It All ("the show") on any official channel. This list of official channels and what constitutes an interaction include:

  • Emailing the official inboxes or either Han and/or Matt ("the hosts")

  • Any interaction on Twitter with either of the hosts

  • Any interaction on the Official Facebook Fan Group

  • Any interaction on the Patron-Only Discord Channel

  • Any interaction on Patreon

  • Mailing anything to our PO Box

  • Attending any Han and Matt Know It All live event

When you interact with the show on any of the above official channels, you agree to the collection and use of personal data in accordance with the policy.

Definitions

  • Interact(ion):

An interaction with the show is any activity between you and the hosts through an official channel that the hosts manage (e.g. tweeting at, following on social media, meeting, messaging, becoming a patron, unlocking the criteria for an achievement badge, and so on). Your personal data is not collected by the hosts through any unmentioned or unofficial channels.

  • Official Channel

An official channel is any platform, venue, or means of interaction with the hosts that is owned, managed, or controlled by the hosts.

  • Unofficial Channel

An unofficial channel is any platform, venue, or means of interacting with fellow fans of the show or the hosts that are not owned, managed, or controlled by the hosts.

  • Personal Data

Personal data is data about a living individual who can be identified from any collected data (or from any data and other information either in our possession or likely to come into our possession).

  • Data Controller

A data controller is the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be, processed. For the purpose of the policy, the hosts are a data controller of your personal data.

  • Data Processors

A data processor is any natural or legal person who processes the data on behalf of the data controller. The hosts are the sole and exclusive data controllers and data processors for all personal data that ever has been and will be collected.

  • Data Subject

A data subject is any living individual who has or will have any interaction with the show. For all intents and purposes, "you" throughout this policy is synonymous with "data subject."

  • First and Last Names

  • Email Addresses

  • Fantasy Aliases / Listener Leader Board Aliases

  • Social Media Handles (Twitter)

Personal Data that We Automatically Collect

There is no personal data that is automatically collected by or for the hosts on any official channel, nor shared with 3rd parties. We do not use tracking cookies. While we do use Google Analytics (Privacy Shield Certified) on HanandMattKnowItAll.com and Apple's Podcast Connect Analytics (Apple's Privacy Policy), these 3rd party tools do not in any way store personal data nor do they provide personal data to their users or any other party in connection to your interactions with the show. This is an excerpt from Apple's Privacy Policy (emphases added):

  • "We may collect information regarding customer activities on our website, iCloud services, our iTunes Store, App Store, Mac App Store, App Store for Apple TV and iBooks Stores and from our other products and services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, products, and services are of most interest. Aggregated data is considered non‑personal information for the purposes of this Privacy Policy."

The Purpose and Use of Personal Data

Personal data is used by the hosts for two and only two purposes. Processing this personal data enables the hosts to:

  1. Quickly reference who any given data subject is given that there are myriad aliases they may use across the internet and/or in person. This use ensures that the hosts can more systematically, effectively, and efficiently manage relationships with an ever-growing number of data subjects.

  2. Cross-reference, track, and provide prompt and proper credit for the purposes of the publicly-accessible Listener Leader Board and its Achievement Badge system (the Listener Leader Board contains the pseudo-Personal Data of "Fantasy Aliases / Listener Leader Board Aliases").

To reiterate from above, all personal data that the hosts have collected is and always will be used solely and exclusively by the hosts (who are both thus the sole and exclusive data controllers and data processors). Processing of this data includes collection, organization, alteration, and retrieval, but is not and never will be shared with any other non-host entity.

Storage and Protection of Personal Data

Personal data is stored such that any breach attempts would require separate access credentials to unlock the hosts' phone in order to bypass the 2-factor authentication process.

Personal Data Retention

Unless you explicitly inform the hosts otherwise, we retain your personal data indefinitely with the assumption that you are still listening to the show and/or reading the written column. We also retain your personal data for the purposes of complying with our legal obligations (including law enforcement requests), meeting regulatory requirements, resolving disputes, responding to government investigations, maintaining security, preventing fraud and abuse, and protecting our and other’s rights.

Information Disclosure

Advertising

The hosts won’t transfer information about you to third parties for the purpose of providing or facilitating third-party advertising to you. We won’t sell information about you.

Disclosure for Law Enforcement

Under certain circumstances, the hosts may be required to disclose your personal data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Legal Requirements

The hosts may disclose your personal data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation

  • Protect and defend the rights or property of the show and/or the hosts

  • Prevent or investigate possible wrongdoing in connection with the show and/or the hosts

  • Protect the personal safety of users of the the show and/or the hosts or the public

  • Protect against legal liability

Your Data Protection Rights Under General Data Protection Regulation (GDPR)

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. The show aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your personal data.

If you wish to be informed what personal data we hold about you and if you want it to be removed from our database, please submit a request via hanandmattknowitall@gmail.com.

In certain circumstances, you have the following data protection rights:

  • The right to access, update or to delete the information we have on you.

    You can request access, updates, or deletion of your personal data.

  • The right of rectification.

    You have the right to have your personal data rectified if that personal data is inaccurate or incomplete.

  • The right to object.

    You have the right to object to our processing of your personal data.

  • The right of restriction.

    You have the right to request that we restrict the processing of your personal data.

  • The right to data portability.

    You have the right to be provided with a copy of the personal data we have on you in a structured, machine-readable and commonly used format.

  • The right to withdraw consent.

    You also have the right to withdraw your consent at any time where the show relied on your consent to process your personal information.

Please note that we may ask you to verify your identity before responding to such requests.

You have the right to complain to a Data Protection Authority about our collection and use of your personal data. For more information, please contact your local data protection authority in the European Economic Area (EEA).

Changes to the Policy

The hosts may periodically update this policy. We’ll notify you about significant changes to it via the podcast. The most current version of the policy will always be here.
